Abstract
Nurses are currently practicing in the midst of a litigious society which is growing larger every day. Several factors contribute to the increase of malpractice lawsuits against nurses including increased regulatory requirements for education, advances in technology, the nursing shortage and downsizing, increased autonomy of hospital nurses, and better informed consumers. For all of these reasons and more, nurses must be educated about the legal implications of practice so they can avoid being sued.

Mock trials are an innovative approach to nursing education which can be used to educate nurses about standards of care, regulatory requirements, policies and procedures, principles of documentation, scope of practice, and legal implications in just one learning event. To use this approach, the education team develops a mock trial scenario, patient medical record and mock trial questions based on identified learning needs. Nursing staff then participate in the mock trial simulation by playing the roles of attorney, witness or jury members. Research has demonstrated several positive benefits of using this approach which include enhanced critical thinking, increased team building, the ability to recognize standards of care in daily practice and an awareness of the legal implications of documentation.
