This session will explore the fundamental differences between the regulation of beverage products and liquid dietary supplements by the FDA. Justin Prochnow will discuss the pros and cons of selling a product as a beverage or dietary supplement, including considerations regarding ingredients, manufacturing, and claims. Additionally, Mr. Prochnow will discuss the need for proper substantiation and the scrutiny over claims from the Federal Trade Commission, the National Advertising Division of the BBB, District and State Attorneys’ Offices, and private litigants. Attendees should come away from the session with a better idea of the regulatory framework for liquid products and an understanding of the range of permissible claims that can be made to promote and advertise products.
